Prattville, AL.Local knowledgeProcess expertiseResponsivenessNegotiation skillsI toured a beautiful 1930s home listed by Andy Wiloughby and quickly made an offer. We settled on a price, and I put down $1,000 in earnest money, plus another $1,000 for an inspection. Unfortunately, the inspection revealed serious issues—foundation...Response from Andy Willoughby on 6/2/2025
Lauren, you have been given inaccurate information and advise from your agent. I have not spoken to you over the phone at all and your review is false and 100% inaccurate. I shared the sellers response to your agent about your request to terminate the contract and have the earnest money deposit returned to you. As an agent I have ZERO control of the earnest money deposit. Per the contract you agreed to, "the earnest money deposit will be returned or released to a buyer or seller ONLY if both parties agreed." The seller feels you did not submit a repair request form, defect notice, or price reduction request along with a copy of the report showing the repairs deemed necessary per the terms of the contract you agreed to. Therefore the seller did not agree to release the earnest money deposit to you. I have ZERO control over this issue. As far as your quote that I said your earnest money would not be released for up to 2 yrs on principle thats 100% a lie. Again per the contract you agreed to it states any earnest money can be held for up to 2 yrs. That is written in the contract. I don't hold earnest money and have no control over it. As far as your comment stating I was unprofessional and not in the spirit of fair dealing. You and the seller signed and agreed to the terms of a contract. You did not follow the terms of that contract and that is why the seller did not agree to releasing the earnest money to you. If a buyer or seller doesn't follow the terms of a contract they agreed to then that person is not participating in fair dealing. I have nothing to do with that. This was your decision and the sellers decision.
