Key Lease Terms / Provisions 1. Utilities and Services Owner/Landlord shall pay for all water and sewer service to the Premises, which is included in the monthly rent. Tenant/Renter is solely responsible for all other utilities and services, including but not limited to gas, electricity, cable/internet, and any other services not expressly provided by Landlord. Tenant must establish and maintain accounts in their name for these services starting on the move-in date. Failure to maintain these services may constitute a material breach of the Lease. 2. Rent Payments Prepaid Last Month's Rent In addition to the first month's rent and security deposit due at signing, Tenant shall pay an amount equal to one (1) full month's rent as prepaid last month's rent. This prepaid amount shall be applied solely to the final month of the tenancy (or the last month occupied if tenancy ends early). It is not part of the security deposit and shall not be used for any other purpose (e.g., damages, cleaning, or unpaid rent during the tenancy) unless agreed in writing. Note: Total upfront charges (first month's rent + security deposit + prepaid last month's rent) comply with California law limiting security deposits to one month's rent; the prepaid last month's rent is treated as advance rent, not deposit. 3. Security Deposit Security deposit shall be in an amount equal to one (1) month's rent (maximum allowed under California Civil Code 1950.5 as amended). It will be held by Landlord to cover potential damages beyond normal wear and tear, unpaid rent (if applicable at end of tenancy), cleaning, or other Tenant obligations. Landlord will provide an itemized statement and return any remaining balance (with interest if required) within 21 days after Tenant vacates and provides forwarding address, per California law. 4. Term of Lease This is a fixed-term lease with a minimum term of one (1) year, commencing on [Insert Start Date] and ending on [Insert End Date, e.g., one year later]. The lease shall automatically convert to a month-to-month tenancy thereafter unless renewed or terminated in writing per California law. 5. No Smoking Smoking of any kind (including tobacco, e-cigarettes, vaping, marijuana, or other substances) is strictly prohibited anywhere on the Premises, including inside the dwelling unit, on decks/balconies, in the yard, driveway, or any other part of the property (including shared areas). This prohibition applies to Tenant, household members, guests, and visitors. Pets Up to a total of three (3) pets are permitted on the Premises, subject to Landlord's prior written approval for each pet (via a separate Pet Addendum if required). -Tenant must provide current vaccination records, breed/type/weight, and proof of spay/neuter (if applicable) before approval. -Pets must be well-behaved, non-aggressive, and not create a nuisance (e.g., excessive barking). -Tenant is solely responsible for all pet-related damages, which may be deducted from the security deposit. -It is mandatory that Tenant immediately pick up and properly dispose of all pet waste in the yard or any outdoor area. Failure to do so constitutes a violation and may result in cleaning fees or termination. -No additional pets (including strays or visitors' pets) are allowed without written consent. 7. Yard and Property Maintenance Tenant shall keep the yard and entire Premises clean and free of loose trash, debris, or clutter at all times. Tenant is responsible for regular yard maintenance (e.g., mowing, weeding, watering if applicable) unless otherwise specified. Pet waste must be removed promptly and disposed of properly (not left in yard or trash cans improperly). Any violation may result in Landlord performing cleanup and charging Tenant reasonable costs (deductible from security deposit if unpaid). 8. Parking and Driveway Rules No parking, staging, storage, or repair of vehicles (including RVs, trailers, boats, or inoperable vehicles) is permitted in the shared driveway on Mono Road.
