After listing and selling Lyle’s home very quickly with multiple offers, he selected a beautiful new construction home to purchase. There were multiple builder delays, but there were also assurances and concessions made by the builder that Lyle was willing to accept in order to complete the transaction so that his family could get settled in their new home. I negotiated a $100.00 per day penalty from the builder which resulted in over $15,000.00 in buyer credit which Lyle received at closing. In addition, the builder upgraded the upstairs flooring ($2500.00) and performed several other upgrades at no additional cost. These builder concessions did not absolve him of responsibility and the excessive delay in completion, but did provide Lyle with some compensation. It is not common in our market to escrow funds. I did explore this as a possibility with the lender who would not allow this. Escrow companies do not allow funds to be escrowed unless directed by the parties, and again the lender would have to agree. I advised Lyle that I would not question his walking away from the transaction as delays and frustrations increased, and that he should not close until he was happy with the work done. Lyle assured me that he wanted to proceed with the sale and move in as soon as possible, despite work left undone and whether the builder fulfilled his promises or not. I have continued to offer my assistance, provide any requested documentation, and introduced Lyle to a real estate attorney. It is shameful that the builder has not honored his commitments.
